GUARANTEES
1. Dog is purebred, pedigree is correct; litter is registered with the AKC. Puppy's individual registration application (or certificate) will be provided when payment is made in full, contract is signed, rental crate is returned (if applicable). If the spay neuter agreement is checked above, then proof that the dog has been altered must be provided before registration certificate is supplied.
2. Dog is healthy on delivery, has been wormed, vaccinated, and when shipped by air, comes with a veterinarian health certificate. A veterinarian must confirm illness within 72 hours of arrival. After that, the health of the dog is the responsibility of the buyer.
3. If the dog is sold with limited registration checked above, the dog is guaranteed against clinical crippling hip or elbow dysplasia that will interfere with the dog’s quality of life for the period of 1 (one) year from the date of purchase. That would be an OFA grade of Moderate or Severe dysplasia on hips, or anything worse than DJD grade 1 on elbows. There needs to be clinical and radiographic proof of this.
4. If dog is sold with Full Registration checked above, dog is guaranteed for the time period of 2 (two) years from the date of purchase against hip or elbow dysplasia. That would be an OFA grade worse than OFA mild on hips, or anything worse than DJD grade 1 on elbows. Hip X-rays must be taken and submitted to the OFA before the age of 26 months, and BEFORE BREEDING to qualify for this guarantee. If the dog was bred before OFA x-rays then this contract is null and void.
5. This guarantee is for a replacement puppy only and not for a refund of the purchase price of the original puppy. If a replacement puppy is warranted then the breeder will give a replacement puppy after the original AKC papers from the first puppy have been returned to the breeder and proof of spay or neuter from a licensed veterinarian is given to the breeder. The buyer will keep the original puppy as well. I will not give a replacement until the original papers from the first puppy have been received back as I would not want a dysplastic dog being bred.
This puppy is sold solely as a pet and companion to the immediate family (those living in the home when the puppy is first brought home). His suitability for any additional use will depend solely on the environment and training provided by the buyer. Puppies sold with full registration are judged by the seller, at the time of sale, to have show and breeding potential only, and are not guaranteed to be showable or breedable at maturity. These guarantees apply to the original purchaser only and are not transferable. This guarantee becomes null and void if the buyer does not return signed contract, does not submit the AKC registration application to AKC within one month of receiving the form, the buyer sells, trades, leases out, or euthanizes (except to end suffering in an emergency situation) the dog, or if the dog produces any offspring before hips and elbows have been x-rayed. The breeder/seller reserves the right to a second veterinarian's opinion. All relevant veterinary records must be supplied to the breeder/seller upon request. When the cause of death is unknown, an autopsy (necropsy) must be performed.
If the buyer can verifiably demonstrate the dog's failure to fulfill these guarantees, the seller will replace the dog with a puppy of similar value once proof of spay or neuter by a licensed veterinarian is given to the seller along with the original AKC papers of the dog. The buyer’s remedy for the breach of any aforementioned guarantee is limited to the purchase price of the dog on this contract.
BUYER'S AGREEMENTS
1. Buyer agrees to use the kennel name "vom haus Bjarne" as the dog's last name and a first name beginning with the letter _______ on the AKC registration application.
2. Buyer agrees to register puppy with AKC (or transfer ownership if the dog is already registered) within 1 month of receiving the form and send a photocopy of the certificate to the seller.
3. Buyer agrees not to take the puppy to any place’s where there are large concentrations of dogs and or wildlife until it has received several more shots by your veterinarian plus two additional weeks.
4. Buyer agrees that in the event that the puppy develops any type of hip and or elbow dysplasia within the guaranteed period of time, you will need to contact the breeder immediately upon diagnosis from a licensed veterinarian. The diagnosis of hip or elbow dysplasia needs to be confirmed by x-rays, and those x-rays will have to be sent off to the Orthopedic Foundation for Animals (OFA) for evaluation and ratings. You will need to supply the breeder with a copy of the OFA report on the dog and the veterinarian’s reports of the diagnosis along with signed permission to speak with the veterinarian regarding this puppy.
5. Buyer is responsible for any veterinary, x-ray fees, and OFA fees.
6. Buyer agrees to inform seller when they move or change phone numbers for the life of the dog.
7. Buyer agrees not to sell, trade, lease out, euthanize (except under emergency conditions to end suffering), or give away the dog without the permission of the seller. (I would not sell a puppy to some people who are not responsible dog owners and I also would not want them to buy one of my dogs from a third party.)
8. Buyer agrees to comply with all local ordinances regarding the keeping of dogs, in addition to providing adequate food, water, housing, immunizations and health care, and humane treatment for the dog.
9. If limited registration is checked above, buyer agrees to prevent the dog from breeding (even by accident) and buyer agrees to have dog spayed/ neutered within 30 days, or before the age of 1 year, whichever is later.
If the seller can document the buyer's failure to keep these agreements and so informs buyer by certified letter, the buyer shall have 72 hours to return the dog and the signed AKC registration transfer to the seller at his own expense. If buyer fails to do so, the seller shall have the legal right to repossess the dog and get a signed AKC transfer application from the buyer without refunding any money. In addition, the buyer shall be liable for any expenses incurred in the process of repossession (including attorney's fees and court costs), and vet expenses to restore the dog to good health if necessary. If it is not possible for the buyer to return the dog and AKC registration, the seller will recover the greater sum of $500 or the purchase price of the dog, as damages for breach of contract. No other warranties or guarantees, expressed or implied, are made with this sale. I have read and agree to the above conditions.
